PALS Suggested Answers to the 2008 Bar Examinations

New product

Bar examinations are a defining moment in the life of every lawyer. The successful hurdling of the bar is the culmination of years of scholastic training in law school. Every examinee is expected to demonstrate his familiarity with the countless doctrines, principles, rulings, and everything else found in jurisprudence. The arduous preparation for the bar is often regarded as overwhelming, if not a nearly impossible feat of intellectual endurance. And, assuming that one has put in a decent effort at review, he must contend with the good fortune of being questioned on those matters that seem clearest in his head. In addition to some good luck, the examinee must then summon his writing skills to transmit his knowledge in the essay portions of the exams.

Facility of written expression is an indispensable tool that every lawyer must carry in his arsenal of legal skills. While mastery of the English language is an unquestionable advantage, it cannot – in and of itself—define the requisite intellectual competence for admission to the practice. Moreover, practitioners, the courts and even clients have now come full circle, moving away from the overuse of “legalese” and favoring direct, plain English to convey even the most complex legal issues.

It can be said that there are no difficult exams; rather, there are only strict or unbending correctors. Indeed, the purpose of the Suggested Answers Series is two-fold: first, to provide quick review material for the bar examinees, and second, to provide succinct, yet accurate responses to the bar questions, in assisting the examiners in their correction of the exams. This approach discourages reliance on specific words and detailed phrases that only serve to limit the range of acceptable answers to the bar questions. Similarly, it trains the examinee to focus squarely on the issue being raised in the question and to respond without unnecessary flair or drama, which often leads to poor, unintelligible answers.

Withal, it is our hope that the Suggested Answers will aid in the fair evaluation of the examinee’s abilities, as he seeks admission to the legal profession.

Success consists in being successful, not in having potential for success. Any wide piece of ground is the potential site of a palace, but there’s no palace till it’s built. (Fernando Pessoa, The Book of Disquiet)
