This present edition updates this book to include new materials on the subject. While the basic structure remains the same, certain portions of the book were transferred to the introductory part particularly the discussion on the nature and concept of intentional torts. Discussion of other topics are expanded to reflect current jurisprudence and to further clarify and supplement the discussion.
As noted in an earlier edition, the writing of this book was the result of the writer’s effort to understand the subject and to organize the materials into a coherent work. Nevertheless, examination and interrogation of prevailing rules and the different aspects of tort law is a continuing endeavor. Hence, this work reflects the writer’s evolving views on different issues on torts and damages and his continuing re-examination, rethinking, and further research not only on what was written in the previous editions but also on the rulings of the Supreme Court and applicable laws. Teaching the subject again likewise led to the other changes in the book.
All the edited cases that appear in previous editions are still in this edition although some of them are integrated in the discussion. The edited cases that remain are not necessarily leading cases but they are selected mainly because they are useful study guides. The illustrative cases that are reproduced are not limited to vehicular accidents; the author tried to cover a wider spectrum of human experience with the result that this work contains a compendium of human miseries that are alleviated by court awarded damages. It is not possible and not cost-effective to reproduce all the important cases in this book even in their edited form; however, it is strongly suggested that the important cases cited in this work that are readily available not only in libraries but in different websites, should be read in the original to better serve as pedagogical tools.
New laws are also incorporated in the discussion insofar as these laws affect tort rules. For example, the provisions of the Mental Health Act (R.A. No. 11036) on Informed Consent are included in Chapter 4.

1. Orders are normally dispatched on the next business day following the day the order was confirmed to the customer. Orders for delivery within Metro Manila will be delivered within 3 to 5 days from the process date of the order. While for the orders to be delivered to a provincial destination will take 5 to 10 days from the process date to be delivered.
