The first edition of this book was written in 1969 and published in the following year. It was only when the author started its present revision that he realized that more than forty years had elapsed since the time his Commercial Law department head at the University of the East, Justice Justo P. Torres, Jr. saw his notes on Insurance. The author was encouraged by Justice Torres, Jr. to make a book out of his notes. It was published and this is the sixth edition. The author cannot fathom why after all these years, he still teaches and writes. Certainly it is not for the meager income but perhaps, teaching and writing make him feel young and give him a sense of accomplishment. As the Roman statesman, Marcus Porcius Cato said, “A man who is always living in the midst of his studies and labors does not perceive when old age creeps upon him.”

The amendment of the Insurance Code of 1978 by Republic Act No. 10607 made the revision of the 2006 Edition of this book a necessity. The amendment of the law came at a time when the author has finished his additional research and was about to embark into the revision of this book although originally he intended it to be completed in 2014 yet. The amendment of the law hastened the said revision. The Insurance Code of 1978 was a good law but as Aristotle said, “they ought not always to remain unaltered.” The law has to adjust to the changing times.

The Insolvency Law under Act No. 1956 has been repealed by Republic Act No. 10142 otherwise known as Financial Rehabilitation and Insolvency Act of 2010, which is another reason why the revision of this book becomes imperative. The author does not want to relegate his works in the museum of obsolete books during his lifetime.

In presenting Bar Examination questions from 2005, the author included all questions in Mercantile Law and made the questions in Insurance in bold letters for easy identification. The author included all questions in Mercantile Law so the students of law will have an insight on the type of the questions asked in recent times, especially the “Multiple Choice Questions.”

Atty. Edna B. del Rosario, Director of the Legal Aid Office and Associate Dean of the College of Law of the University of Batangas helped me in my research. The author’s secretary, Ms. Margarette P. Mendoza, and student assistant, Ms. Christine Ann B. Conti, helped in the preparation of the manuscript, and without them, the author would take more months to finish it. I am grateful to them and to my ever-loyal secretary for the past three decades, Ms. Elizabeth Quidangen. And last but not the least, author is also indebted to Atty. Marcial O.T. Balgos, his law partner for many decades; his mentor’s son, Atty. Senen de Santos, and his classmate at the Ateneo Law School, Atty. Ruben Fruto for the help they have extended to the author.

1. Orders are normally dispatched on the next business day following the day the order was confirmed to the customer. Orders for delivery within Metro Manila will be delivered within 3 to 5 days from the process date of the order. While for the orders to be delivered to a provincial destination will take 5 to 10 days from the process date to be delivered.
