This 5th Edition is put into one piece after 20 years has passed since this humble author published his first book titled “The National Internal Revenue Code (NIRC), 1998 First Edition.”

The passage of RA No. 10963, otherwise known as the Tax Reform for Acceleration and Inclusion (TRAIN) or the TRAIN Law for brevity, which amended 69 sections of NIRC, created 8 new sections and repealed 3 sections of the Tax Code, made the revision of the book imperative in order to explain and guide the public on the changes, implementation and effect of the new tax reform.

On December 19, 2017, in signing the TRAIN Law, President Rodrigo Duterte said, “For two decades, we have been constrained by the outdated provisions of our tax laws under the National Internal Revenue Code, as amended. In particular, the high personal income tax rates have placed a significant burden to our laborers. x x x This momentous achievement would not be possible without the collective efforts of our legislators in the 17th Congress, in particular, the Chairmen of the House Committee on Ways and Means, and the Senate Committee on Ways and Means.”

Having been a part in all the deliberations in the Senate and in bicameral conference meetings on the Senate and House versions of the TRAIN, in my capacity as the Director General of the Senate Tax Study and Research Office (STSRO) and assisted Senator Sonny Angara, Chair of the Senate Committee on Ways and Means (the steward of the TRAIN Law), it is dutiful on my part to explain the new provisions in this book as well as to clarify the legislative intent to ensure better understanding and interpretation of the tax reform.

Prodded by the public to come-out with an updated version on the author’s NIRC 4th edition to better understand the land-mark tax reform and encouraged by the kind words of Senator Sonny Angara and the chance to work with the workaholic solon in the passage of the TRAIN Law, when he said on September 20, 2017 (Sponsorship Speech on SB 1592 — Senate version of the TRAIN Law), December 13, 2017 (Conference Committee Report Statement), “I would like to thank the Senate Secretariat, especially the Senate Tax Study and Research Office”, and on November 28, 2017 during the approval on 3rd reading of SB 1592 when he said, “I would like to mention the unsung people or unsung heroes of this bill, Mr. President, because there are so many of them, I will start with our staff, they are here around-us, maraming salamat po sa kanila, sa Senate Tax Study and Research Office headed by Atty. Dascil.” (Underscoring supplied)

Thus, putting the 5th edition of this book into one piece is anchored on the author’s solemn duty as a lawyer to support effort to achieve high standards in law schools and assist in disseminating information regarding the law and jurisprudence. (Canon 5, Code of Professional Responsibility)

As in previous editions, the author painstakingly provided annotation to each section explaining in details the changes made in 69 sections of the Tax Code by comparing the old provisions to the new provisions, as well as to clarify the legislative intent in the 8 new sections and 3 repealed sections with the end in view of giving a better understanding and interpretation to the TRAIN Law.

Moreover, the Revenue Regulations (RR Nos. 1 to 13-2018) issued by the Bureau of Internal Revenue (BIR), implementing the TRAIN Law, as well as other provisions of the Tax Code, are also cited in the annotations of this book to crystallize even further the developments in the Tax Code.

It is the intention of the author to equip law students, bar reviewees, accountants, bookkeepers and other practitioners with the knowledge on the latest changes in our country’s tax landscape to guide them in their respective practices on the proper application and implementation of the Tax Code.

SHIPPING

1. Orders are normally dispatched on the next business day following the day the order was confirmed to the customer. Orders for delivery within Metro Manila will be delivered within 3 to 5 days from the process date of the order. While for the orders to be delivered to a provincial destination will take 5 to 10 days from the process date to be delivered.
2. RETURNS

1. If you would like to return a book purchased in Rex e-Store due to product defect, Rex Book Store shall facilitate a replacement. However, shipping and handling charges are non-refundable.
2. Please advise us within seven (10) days from receipt of the item, of your intent to return an item, including the corresponding reason or actual product defect.
